New Mexico Individual Income Tax Provision
To assess state residents' individual income tax, New Mexico uses a joint filing system, one of three different methods used by states. The joint filing system combines the incomes of both partners in a married couple and taxes them as one amount, creating the notion that the couple is a single economic unit.
Same-sex marriages are recognized in New Mexico, which means these couples are taxed exactly the same as opposite-sex married couples, and can chose to file a joint return.
The tax base in New Mexico starts with federal adjusted gross income, and generally follows all the same rules as the federal law. There are a few minor exceptions.
Exemptions
Some sources of income are subject to exclusion from the state tax base. These include:
- Interest from U.S. government bonds
- Active duty military pay
Deductions
New Mexico uses the same standard deduction as the federal law, as well as adding other deductions residents should be aware of. Deductions exist for:
- The greater of 50% or $1,000 of federally taxed capital gains
- Up to $8,000 for taxpayers over 65 or blind who meet certain income limits
- Contributions to an approved New Mexico Section 529 college savings account
- Contributions to medical care savings accounts
- Medical care expenses for persons over 65
- Organ donation expenses
- Unreimbursed medical expenses not taken as an itemized deduction
- Life insurance premium reimbursements for nation guard members
State and local income or sales tax, as well as federal income tax is non-deductible in New Mexico.
